PropPacket Terms of Service & Privacy Policy

1. Acceptance of Terms

By creating an account, logging in, or viewing a packet (the "Service"), you agree to this combined Terms of Service and Privacy Policy ("Agreement"). If you do not agree, do not use PropPacket.

This Agreement applies to all users, including:

• Creators who upload or share property packets; and
• Viewers who access or interact with property packets.

2. Beta Status

PropPacket is currently in beta testing and provided free of charge for evaluation purposes. Features may change, break, or be removed at any time.

• Access may be limited, suspended, or revoked without prior notice or liability.
• SubTool LLC may delete or make your data inaccessible at any time, including after the beta period or if you do not transition to a paid plan once available.

3. Ownership & Intellectual Property

All rights, title, and interest in PropPacket—including its software, design, layout, branding, code, and features—belong exclusively to SubTool LLC.

You agree not to:

• Copy, reverse-engineer, reproduce, or exploit any part of the Service;
• Use PropPacket to build, assist, or inform a competing software or product;
• Remove, hide, or alter any branding, copyright, or proprietary notices.

4. Information We Collect

4.1. From Creators

• Name, email address, phone number, login credentials, and usage data.
• Property details, photos, and other uploaded content.

4.2. From Viewers

• Name, email, and phone number entered before viewing a packet.
• Packet interactions such as views, clicks, time spent, and engagement data.

4.3. Automatically Collected Data

• IP address, browser type, device identifiers, and other technical details.
• Cookies and similar tracking technologies for analytics, personalization, and marketing.

5. How We Use Information

SubTool LLC may use collected data to:

• Operate, maintain, and improve the Service;
• Communicate with users and viewers;
• Provide marketing and promotional materials;
• Analyze usage and performance;
• Develop new products or features;
• Comply with applicable legal obligations.

6. Data Sharing and Sale

Standard message and data rates may apply. Transactional or system messages (like account notifications or password resets) will continue as needed.

To the fullest extent permitted by law, SubTool LLC shall not be liable for any indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption.

14. Indemnification / Hold Harmless

You agree to indemnify, defend, and hold harmless SubTool LLC, its officers, employees, and affiliates from and against any claims, losses, damages, or expenses (including attorney's fees) arising out of your use of the Service or violation of this Agreement.

15. Children's Privacy

PropPacket is not intended for individuals under the age of 18, and SubTool LLC does not knowingly collect data from minors.

16. Updates to This Agreement

We may update this Agreement at any time by posting a new version on our website.

Continued use of the Service after updates become effective constitutes acceptance of the revised terms.

17. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of Texas, excluding its conflict-of-law rules.

Any disputes will be resolved exclusively in the state or federal courts of Dallas County, Texas.
